Terms and Conditions — Effective August 2, 2025

1. Online Store Terms

By using this website, you represent that you are at least the age of majority in your state or place of residence, or that you have permission from a parent or legal guardian to use the website.

You may not use our website or products for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not attempt to interfere with the website, introduce malicious code, gain unauthorized access to our systems, or violate any applicable law.

We reserve the right to refuse service, cancel an order, restrict website access, or terminate an account when we reasonably believe these Terms have been violated.

2. DivinePrint Products

DivinePrint offers artwork reproduced on products that may include:

• Canvas prints
• Metal prints
• Desktop prints
• Limited or specialty print products
• Other artwork and products introduced through our website

Unless expressly stated otherwise, DivinePrint sells reproductions and printed products rather than original paintings.

Product availability, materials, finishes, mounting methods, sizes, prices, and customization options may change without notice.

3. Made-to-Order and Customized Products

Many DivinePrint products are created, printed, finished, or prepared after an order is submitted. Products may be made according to the artwork, size, material, finish, orientation, mounting option, or other selections chosen by the customer.

You are responsible for reviewing all selections before completing checkout. Once production begins, an order may not be changed or canceled.

DivinePrint is not responsible for an incorrect size, material, finish, orientation, artwork, shipping address, or other option selected or entered by the customer.

We may contact you for clarification if an order contains conflicting, incomplete, or unusual selections. Production may be delayed until the necessary information is received.

4. Artwork and Color Variations

We make reasonable efforts to display artwork and product colors accurately. However, the appearance of an image may vary depending on:

• Screen brightness and display settings
• Device type and color calibration
• Printing materials and production methods
• Canvas, metal, coating, or finish selections
• Lighting conditions in the customer’s space
• Natural variations created during production

Colors shown on a phone, tablet, or computer screen may not perfectly match the finished product.

Minor differences in color, texture, placement, cropping, finish, dimensions, or appearance that do not materially affect the product’s intended use are not considered defects.

5. Product Images and Room Mockups

Room scenes, digital mockups, lifestyle images, and product previews are provided to help customers visualize the artwork.

These images may not represent the exact size, scale, texture, color, hardware placement, frame depth, surface finish, or surrounding environment of the finished product.

Customers should review the listed product measurements before purchasing and measure their intended display area carefully.

Decorative furniture, walls, lighting, and accessories shown in product images are not included unless expressly identified as part of the product.

6. Orders and Order Acceptance

Submitting an order does not guarantee that the order has been accepted.

We reserve the right to accept, reject, limit, or cancel an order for reasons that may include:

• Product or material unavailability
• Pricing or description errors
• Suspected fraud or unauthorized payment
• Incomplete or inaccurate customer information
• Production limitations
• Shipping restrictions
• Violation of these Terms

If we cancel an order after payment has been processed, we will issue a refund for the canceled portion of the order to the original payment method.

We may limit quantities purchased by one person, household, account, payment method, or shipping address.

7. Prices and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

Prices may change without notice. A price change will not normally affect an order that has already been accepted, except when a clear pricing or technical error has occurred.

You agree to provide current, complete, and accurate billing and payment information. You authorize DivinePrint and its payment providers to charge the total amount shown during checkout, including applicable taxes, shipping costs, and other disclosed charges.

DivinePrint does not directly store complete payment-card information. Payments may be processed through Shopify or another authorized third-party payment provider.

8. Taxes

Applicable sales tax or other transaction taxes may be calculated during checkout based on the order, product, billing information, shipping destination, and applicable law.

You are responsible for any taxes, duties, customs charges, import fees, brokerage charges, or similar expenses not collected during checkout.

9. Production and Processing Times

DivinePrint products may require production, inspection, finishing, packaging, and processing before shipment.

Any processing or production time shown on the website is an estimate and is separate from the carrier’s transit time.

Orders may require up to seven business days for processing unless a different timeframe is displayed on the applicable product or checkout page.

Business days generally do not include weekends or recognized holidays.

Production may take longer during sales, holidays, periods of unusually high demand, supplier interruptions, severe weather, emergencies, or other circumstances outside our reasonable control.

10. Shipping and Delivery

Shipping and delivery dates are estimates and are not guaranteed unless DivinePrint expressly states otherwise in writing.

Estimated delivery information may include both:

1. The time required to produce and process the product; and
2. The time required for the shipping carrier to transport the package.

Once an order is transferred to the shipping carrier, delivery timing may be affected by carrier delays, weather, service interruptions, address problems, regional restrictions, or other circumstances outside DivinePrint’s direct control.

When tracking information is available, it will normally be sent to the email address or contact information provided with the order.

You are responsible for providing a complete and accurate shipping address. DivinePrint is not responsible for delays, losses, or additional expenses caused by an incomplete or incorrect address supplied by the customer.

If an order is returned because of an incorrect address, refusal, failed delivery, or failure to retrieve the package, additional shipping or handling charges may apply before the order can be shipped again.

Please review our separate Shipping Policy for additional information. The Shipping Policy is incorporated into these Terms by reference.

11. Shipping Delays

DivinePrint will make reasonable efforts to ship orders within the timeframe communicated to the customer.

If we become aware that an order cannot be shipped within the promised or reasonably expected timeframe, we may contact the customer with an updated estimate and any options required under applicable law.

An estimated arrival date shown on the website does not create a guaranteed delivery deadline.

12. Lost, Stolen, or Misdelivered Packages

Customers should notify DivinePrint promptly when tracking information shows an unexpected delay, delivery to an incorrect location, or delivery when the package cannot be found.

We may ask the customer to:

• Verify the shipping address
• Check with household members or neighbors
• Inspect alternate delivery areas
• Contact the shipping carrier
• Complete a carrier claim or written statement
• Provide additional information needed to investigate the shipment

DivinePrint will review each situation individually. A replacement or refund is not automatic merely because carrier tracking identifies a package as delivered.

Nothing in this section limits any right or remedy that cannot lawfully be excluded.

13. Inspection After Delivery

Please inspect your order promptly after delivery.

If the product arrives damaged, defective, or incorrect, contact DivinePrint within 14 days after delivery. Include:

• Your name
• Order number
• A description of the problem
• Clear photographs of the product
• Photographs of the packaging and shipping label when shipping damage is involved

Please keep the product and all original packaging until DivinePrint provides further instructions. Discarding the packaging may prevent us or the shipping carrier from properly evaluating a damage claim.

14. Returns, Refunds, and Exchanges

Because DivinePrint products are printed, prepared, or customized for each order, all sales are final, except where required by law or where a product qualifies under our Return Policy or Lifetime Warranty.

We do not accept returns, refunds, or exchanges based solely on:

• A change of mind
• An incorrect size selected by the customer
• An incorrect artwork, material, or finish selected by the customer
• A product not matching the customer’s room or décor
• Minor color differences between a screen and the printed product
• Failure to read product descriptions or measurements
• Normal characteristics of the selected printing material

A product that arrives damaged, contains a confirmed manufacturing defect, or is materially different from the item ordered may qualify for a replacement or exchange.

When an exchange is approved, the replacement will generally be for the same artwork, size, material, frame, and finish as the original order unless DivinePrint agrees otherwise.

Please review our separate Return Policy for complete eligibility requirements and instructions. The Return Policy is incorporated into these Terms by reference.

15. Lifetime Warranty

Certain qualifying DivinePrint products may include a limited lifetime warranty.

The warranty applies only to eligible manufacturing defects or failures expressly covered by the Lifetime Warranty terms. It does not cover:

• Normal wear and aging
• Accidental damage
• Scratches, dents, punctures, or impact damage
• Improper installation or hanging
• Mishandling, misuse, or neglect
• Exposure to excessive moisture, heat, sunlight, smoke, chemicals, or unsuitable environmental conditions
• Damage caused by cleaning products or improper care
• Damage caused by modification, repair, or alteration
• Theft, loss, or shipping damage occurring after a confirmed delivery
• Minor differences in color, texture, or appearance
• Products purchased from an unauthorized seller
• Products without reasonable proof of purchase

The warranty is available only to the original purchaser unless otherwise stated. Proof of purchase and photographs may be required.

When a valid warranty claim is approved, DivinePrint may, at its discretion and subject to applicable law, repair the product, replace the product, provide a comparable replacement, or offer another appropriate remedy.

The customer may be responsible for shipping or handling expenses unless prohibited by law.

The warranty does not guarantee that discontinued artwork, materials, hardware, finishes, or sizes will remain available. When an identical replacement is unavailable, DivinePrint may offer a reasonably comparable alternative.

16. Order Cancellations and Changes

Because orders may enter production shortly after they are submitted, cancellation or modification requests are not guaranteed.

To request a change or cancellation, contact DivinePrint as soon as possible. If production has not begun, we may attempt to accommodate the request.

Once printing, customization, preparation, or production has started, the order generally cannot be changed or canceled.

DivinePrint reserves the right to cancel an order when necessary because of fraud concerns, product unavailability, production problems, pricing errors, shipping limitations, or other reasonable business circumstances.

17. Promotional Offers and Discount Codes

Promotions and discount codes:

• May be available only for a limited time
• May apply only to qualifying products
• May contain minimum-purchase requirements
• May not be combined unless expressly stated
• Have no cash value
• May not be applied after an order is submitted
• May be limited to one use per customer or household
• May exclude taxes, shipping, specialty products, or prior purchases

We reserve the right to modify, suspend, or end a promotional offer when permitted by law.

18. Gift Cards

Gift cards, when offered, are subject to any additional terms disclosed when purchased or used.

Gift cards may not be redeemed for cash except where required by law. Customers are responsible for protecting gift-card information from unauthorized use.

19. Website Content

All information on the DivinePrint website is provided for general informational and shopping purposes.

We make reasonable efforts to keep product descriptions, measurements, pricing, availability, and other information accurate. However, the website may occasionally contain errors, omissions, outdated information, or technical inaccuracies.

We reserve the right to correct errors, update information, or cancel affected orders when appropriate, including after an order has been submitted.

20. Intellectual Property

The DivinePrint website and its contents may include:

• Artwork and artwork reproductions
• Product images
• Photographs
• Videos
• Graphics
• Logos
• Brand names
• Text
• Product descriptions
• Page layouts
• Designs
• Digital mockups
• Marketing materials

These materials are owned by DivinePrint, licensed to DivinePrint, or used with permission and are protected by applicable intellectual-property laws.

Purchasing a DivinePrint product gives you ownership of the physical product only. It does not transfer copyright, trademark rights, reproduction rights, commercial-use rights, licensing rights, or ownership of the underlying artwork.

Without prior written authorization, you may not:

• Copy or reproduce DivinePrint artwork
• Scan, photograph, trace, or digitally recreate artwork for reproduction
• Sell copies or derivative products
• Use DivinePrint images for commercial purposes
• Remove copyright, branding, or ownership notices
• Upload DivinePrint artwork to print-on-demand or artificial-intelligence systems
• Use website content to train, develop, or improve an artificial-intelligence model
• Represent DivinePrint artwork as your own
• Distribute website content for commercial gain

Limited personal sharing of website links or unaltered social-media posts is permitted, provided the content is not used misleadingly or commercially.

21. Customer Reviews and Submitted Content

When you submit a review, photograph, testimonial, comment, suggestion, or other content to DivinePrint, you represent that:

• You have the right to submit it
• It is truthful to the best of your knowledge
• It does not violate another person’s rights
• It does not contain unlawful, threatening, defamatory, obscene, fraudulent, or malicious material
• It does not contain harmful software or code

You grant DivinePrint a nonexclusive, worldwide, royalty-free right to use, reproduce, display, edit, publish, and share the submitted content for website, customer-service, advertising, and promotional purposes, subject to applicable privacy law.

We may remove submitted content that violates these Terms. We will not condition warranty service or other customer rights on a customer agreeing not to provide an honest review.

22. Third-Party Services and Links

Our website may use or link to services provided by third parties, including:

• Shopify
• Payment processors
• Shipping carriers
• Product-customization applications
• Analytics providers
• Social-media platforms
• Email or messaging providers
• External websites

DivinePrint does not control every third-party service and is not responsible for its independent content, availability, security, privacy practices, or terms.

Your use of a third-party service may be governed by that provider’s own policies and agreements.

23. Privacy

Your submission of personal information through the website is governed by our Privacy Policy.

By using the website, you acknowledge that information may be processed by service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, communicate with customers, and provide website functionality.

24. Electronic Communications

By providing an email address, telephone number, or other contact information, you agree that DivinePrint may contact you regarding:

• Your order
• Payment or fraud verification
• Production questions
• Shipping and delivery
• Customer-service requests
• Warranty or return claims
• Important changes affecting your transaction

Marketing emails or text messages will be sent only as permitted by applicable law and any consent you have provided. You may unsubscribe from promotional communications using the instructions included in those messages.

Unsubscribing from marketing messages will not prevent necessary transactional communications concerning an existing order.

25. Prohibited Uses

You may not use the website:

• For unlawful or fraudulent purposes
• To violate intellectual-property rights
• To harass, threaten, abuse, or discriminate against another person
• To submit false or misleading information
• To distribute viruses, malware, or destructive code
• To collect personal information without authorization
• To scrape, copy, crawl, or reproduce website content through automated means
• To interfere with security features
• To attempt unauthorized access to accounts, servers, or systems
• To place fraudulent orders or initiate abusive payment disputes
• To impersonate another person or organization
• To resell products in a misleading or unauthorized manner

We may suspend or terminate access for prohibited conduct.

26. Disclaimer of Warranties

Except for any express written warranty provided by DivinePrint and any warranty that cannot lawfully be excluded, the website and its content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, DivinePrint disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or free from harmful components.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.

27. Limitation of Liability

To the fullest extent permitted by law, DivinePrint and its owners, employees, contractors, affiliates, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

• Your use or inability to use the website
• A delayed or interrupted website
• The purchase, display, installation, or use of a product
• Loss of data, income, business, opportunity, or profits
• Third-party conduct or services
• Unauthorized website or account access
• Circumstances outside DivinePrint’s reasonable control

To the fullest extent permitted by law, DivinePrint’s total liability relating to a product or order will not exceed the amount you paid to DivinePrint for the product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

28. Installation and Display

Customers are responsible for safely installing, mounting, hanging, and displaying their products.

Before installation, confirm that:

• The wall or surface is suitable
• The selected hardware is appropriate
• The installation method can support the product’s size and weight
• There are no hidden electrical wires, plumbing, or structural hazards
• Installation complies with applicable building or property requirements

Large or heavy products should be installed by a qualified professional.

DivinePrint is not responsible for personal injury, property damage, wall damage, product damage, or other loss caused by improper installation, unsuitable hardware, misuse, or failure to follow installation instructions.

Nothing in this section excludes liability that cannot legally be excluded.

29. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless DivinePrint and its owners, employees, affiliates, contractors, licensors, suppliers, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

• Your violation of these Terms
• Your unlawful or unauthorized use of the website
• Your infringement of another person’s rights
• Content you submit
• Fraudulent or abusive activity associated with your account

This obligation does not apply to the extent a claim results from DivinePrint’s own unlawful conduct.

30. Events Beyond Our Control

DivinePrint will not be responsible for delay or failure caused by circumstances beyond our reasonable control, including:

• Severe weather
• Natural disasters
• Fires or floods
• Labor disruptions
• Transportation or carrier interruptions
• Supplier or manufacturing interruptions
• Utility or internet outages
• Cybersecurity incidents
• Government actions
• Public-health emergencies
• War, terrorism, or civil disturbance
• Material shortages

This section does not eliminate any cancellation, notice, refund, or other obligation imposed by applicable law.

31. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection law applies.

Any dispute that is not resolved informally may be brought before a court of competent jurisdiction as permitted by applicable law.

Nothing in these Terms prevents a customer from exercising rights provided by applicable consumer-protection law.

32. Informal Dispute Resolution

Before filing a legal claim, you and DivinePrint agree to make a good-faith effort to resolve the dispute informally.

Please contact DivinePrint with:

• Your name and contact information
• Your order number, when applicable
• A description of the issue
• The resolution you are requesting
• Supporting documents or photographs

We will make a reasonable effort to review and respond to the matter.

This section does not prevent either party from seeking urgent relief or using a consumer remedy that cannot lawfully be restricted.

33. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or separated from the remaining provisions.

The remaining provisions will continue in full force and effect.

34. No Waiver

A failure by DivinePrint to enforce any provision of these Terms does not waive the right to enforce that provision later.

Any waiver must be expressly stated in writing by DivinePrint.

35. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return Policy, Lifetime Warranty, and any additional terms displayed during checkout, constitute the agreement between you and DivinePrint concerning your use of the website and purchase of products.

If an order-specific written agreement signed by DivinePrint conflicts with these Terms, the order-specific agreement will control for that transaction.

36. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, practices, technology, or legal obligations.

The revised Terms will be posted on this page with an updated effective date.

Changes will apply prospectively unless otherwise required by law. Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.
